2. EXCLUSION OF WARRANTY & ABSOLUTE LIMITATION OF LIABILITY
INHERENT RISKS WARNING FOR EQUESTRIAN ACTIVITIES:

Horseback riding, handling of equines, and participation in equestrian sports involve inherent risks of severe bodily injury, trauma, permanent disability, or death to both the rider and the animal. By accessing this website and purchasing equipment, the Customer explicitly acknowledges these operational risks and unconditionally accepts the total exclusion of liability of the Publisher.

Compliance and Usage:

All saddlery, tack, and equestrian protective equipment (including but
not limited to: helmets, body protectors, airbag vests, saddles, bits, stirrup leathers, and girths) sold on this website must be used strictly for the specific purpose for which they were structurally manufactured, by competent, qualified individuals, and under their sole responsibility. The Publisher shall under no circumstances be held liable for misuse, improper fitting on the animal, unauthorized structural modifications of the gear, negligence in maintenance (such as failure to condition leather or exposure to excessive moisture), or normal wear and tear.

Total Indemnification for Accidents:

Swissdelights Trading LLC formally disclaims any and all liability for any bodily harm, material loss, consequential or inconsequential damage, direct or indirect, suffered by the customer, the rider, the horse/pony, or any third party resulting from the use or technical failure of the equipment sold. The customer bears the exclusive responsibility to perform a thorough safety check of the equipment before every single equestrian session.

Contractual Liability Cap:

 In the event that Swissdelights Trading LLC is held legally liable by
a competent court of law for a claim arising from an order, the maximum aggregate financial compensation or damages shall under no circumstances exceed the net amount (excluding taxes) actually paid by the Customer for the specific product that directly caused the dispute.

 

3. ORDERS, PRICING AND AVAILABILITY

All equestrian goods and gear are offered subject to stock availability from our suppliers or warehouses. In the event that a product becomes unavailable after order confirmation, the customer will be immediately notified via email and fully refunded. Swissdelights Trading LLC cannot be held liable for any cancellation penalties, interest, or consequential compensation.
Prices displayed on the online store are denominated in the chosen currency at checkout. For international deliveries outside of the United Arab Emirates, all customs duties, import clearance fees, local VAT, or state taxes are the sole and exclusive responsibility of the customer. It is the customer's legal duty to file all necessary declarations with their local customs authorities.

 

4. LOGISTICS AND STRICT TRANSFER OF RISK

The transfer of risk regarding loss, theft, destruction, or deterioration of the goods transfers automatically to the buyer upon handing over the packages to the commercial carrier from the warehouses of Swissdelights Trading LLC or its partners. Consequently, all goods travel at the exclusive risk of the buyer.

The customer is legally required to inspect the structural integrity of the packaging and the conformity of the equestrian gear upon delivery. Any transport damage, structural anomaly (crushed package, broken gear, or missing item) must be documented in writing on the carrier's delivery note and reported to Swissdelights Trading LLC within a strict window of 48 hours following receipt. Failure to do so will result in the forfeiture of any claim.

 

5. RETURN POLICY AND SAFETY RESTRICTIONS

Due to strict safety imperatives governing equestrian protective gear and sports equipment, no returns, exchanges, or refunds will be granted for Personal Protective Equipment (PPE) or technical gear (including but not limited to: riding helmets, body guards, airbags, bits, and leather saddlery) once they have been removed from their original packaging, tried on in an equestrian environment (stables, paddocks, arenas), soiled, or if the original packaging is damaged.

For standard eligible items (non-safety gear sizing errors, completely un-worn with tags), return shipping expenses are fully and exclusively payable by the customer, unless an explicit shipping mistake was made and acknowledged in writing by our services. 6. INTELLECTUAL PROPERTY

All structural elements, item photographs, fiches, text descriptions, logos, graphics, layout, and data present on this online store are the exclusive property of Swissdelights Trading LLC or its licensors. Any unauthorized duplication, web scraping, reproduction, or commercial exploitation without a clear prior written consent will trigger immediate legal actions for counterfeiting and unfair competition.

 

7. GOVERNING LAW AND EXCLUSIVE JURISDICTION

This Legal Notice, the general terms and conditions of sale, and any commercial relations or disputes arising thereof shall be governed, construed, and enforced strictly in accordance with the laws in force in the Emirate of Dubai and the Federal Laws of the United Arab Emirates.

In the event of any conflict, claim, or litigation concerning the validity, interpretation, or execution of these terms, and failing a prior amicable settlement, the Courts of Dubai (Dubai Courts) shall hold sole and exclusive jurisdiction. This attribution of jurisdiction is absolute and exclusive, applying to summary proceedings, urgent injunctions, third-party appeals, or instances involving multiple defendants, regardless of the customer's nationality, country of residence, or delivery destination.
